Lord Justice Jackson is set to issue his final report next month on the capping of fixed recoverable costs for claims worth up to £250,000. He has previously proposed a trial period for assessing the scheme.

Many small businesses are put off going to court because of the exposure to costs. The new proposals cap costs for each stage of litigation and therefore limits a business exposure. I believe this to be part of an ongoing process to help SME businesses in getting their cases to court and having access to justice knowing what their exposure to costs will be.
