There are rules and regulations that apply to all businesses.

However, it depends on the structure of your business as to whether it is subject to additional regulations. It is important to be aware of these from the outset, as ignoring them can have a significant impact on your business.

Corporate Governance and Directors Duties

There are procedures to be followed for the proper running of companies and LLPs and, although these can seem unnecessary and overly formal, they can become very important when your business is under scrutiny or you have a third party (an investor or a lender) involved. We have experience in running board and shareholders’ meetings, dealing with disputes at board or shareholders’ level and we can explain the duties of a director in a clear and practical way.

Data Protection

Most businesses will process personal data in some way in the course of their business, not least in relation to their employees. It is important that you follow the rules and put the right documents and procedures in place.

A website must make sure that visitors can easily access its privacy policy together with a link to the business terms of sale/purchase. The privacy policy will inform the visitor on how their personal data are stored and used, why, for how long and what their rights are. Following the implementation of GDPR into UK law and the changes in the Data Protection regime it is important to review your existing privacy policies to ensure they are up-to-date and compliant but also clear and easy to understand by the clients.

Consumer Issues

If you deal with private individuals, you are almost certainly subject to the laws on consumer protection. It’s important that you know what these are.  In some cases (particularly if you provide any kind of credit) you will also need to be licensed.

Competition Law
