Business Transfers and Outsourcing

If you are looking to acquire or dispose of a business (or part of it) or planning to outsource, retender or take back in-house a service such as cleaning or the provision of security guards, the chances are you will need to adhere to the provisions of the Transfer of Undertakings (Protection of Employment) Regulations 2006 which is more commonly referred to as TUPE.

TUPE imposes a number of technical and administrative obligations on organisations which can result in significant financial penalties if ignored. We are experienced at advising on these types of issues and able to help you comply with your obligations under TUPE.

It may be that you need help in making arrangements for the election of employee representatives or an explanation of what information you need to provide to individuals affected by a transfer. You might need advice on identifying those who you need to consult with and where you stand if you cannot agree which employees should transfer.

We can guide you through all of these issues, clearly explaining how the law works and give you ideas of how to achieve your objectives commercially so that TUPE doesn’t stand in your way.
