This Act came into force in December 2005. The effect of the new law means that gay couples can have their relationship registered in the same way as heterosexual couples. This will give them effectively the same rights, obligations and responsibilities that married couples have.
Couples are advised to think about a range of issues when they make a decision to formalise their relationship in this way.
The way that property or other assets are owned need to be considered. Those who have responsibility for children under 18 may need to consider some legal steps to ensure that their children’s needs are taken into account.
Many gay couples are now seeking advice from us with issues such as wills, tax planning and adoption. Problems and confusion can be avoided if these issues are clarified from the start.
