Construction Dispute Resolution


The practice has considerable experience in property and in particular property development.  In addition we have also developed considerable experience in matters of landlord and tenant and commercial property.  Having established a reputation in this area of work, we advise companies on a national and regional basis.

The construction industry in particular is notorious for the number of lengthy and expensive disputes that can arise during the course of a contract.

Mike Key has developed a specialism in this area and completed a Masters Degree in Arbitration and Construction in 2004.

Mike is aware that many construction disputes can end up in costly and time-consuming litigation. Although many standard construction contracts such as JCT (Joint Contracts Tribunal) and ICE (Institute of Civil Engineers) provide for dispute resolution mechanisms Mike is often being asked for help where no such provision has been made.

In the absence of an pre-agreed method of resolving the dispute Mike will give consideration to the most expedient and cost-effective manner of determining the dispute.

Some of the well known methods of Alternative Dispute Resolution include: -

  • Mediation
  • Adjudication
  • Arbitration
  • Expert Determination

Each of these forms of ADR tools has its place and its strengths and weaknesses.  Specialist advice is needed to ensure that the right route is pursued.

Nick Johnson has a wealth of experience in advising on development projects such as joint development agreements.  Problems can occur over the contract becoming unconditional and  whether the conditions have been complied with.  In addition Nick advises on a range of disputes arising from developing land such as planning issues and the rights of third parties.
